End User License Agreement for AITOC,Inc DBA AgileCCPM Applications on Atlassian Marketplace

AITOC, Inc. DBA AgileCCPM implements the Bonterms Standard Agreement for Marketplace Transactions (Version 1.0) (Learn more) as the fundamental End-User License Agreement (“EULA”) for our apps presented on the Atlassian Marketplace at https://marketplace.atlassian.com/vendors/333218560. This standardized Agreement offers a comprehensive, balanced structure to facilitate effective licensing for users of AgileCCPM's applications.
In addition, AgileCCPM has incorporated Provider-Specific Terms underneath to address unique needs and policies for our software services.
This End-User License Agreement (“Agreement” or “EULA”) is a legal contract that presides over the terms under which you (“Customer” or “User”) may utilize AgileCCPM's software application (“App”) available on the AgileCCPM Vendor on Atlassian Marketplace. This Agreement encompasses both the Bonterms Standard Agreement for Marketplace Transactions (Version 1.0) and AgileCCPM’s Provider-Specific Terms, together defining the rights, duties, and limitations for both AgileCCPM (“Provider,” “we,” “our,” or “our company”) and you as the Customer.

BY DOWNLOADING, INSTALLING, ACCESSING, OR OTHERWISE USING OUR APP, YOU ACKNOWLEDGE THAT YOU UNDERSTAND, CONSENT TO, AND WILL ABIDE BY THE TERMS AND CONDITIONS DETAILED IN THIS AGREEMENT.
IF YOU DO NOT AGREE WITH THE TERMS DETAILED IN THIS AGREEMENT AND THE PROVIDER-SPECIFIC TERMS, PLEASE REFRAIN FROM DOWNLOADING, INSTALLING, OR USING THE APP. YOUR UTILIZATION OF THE APP SIGNIFIES YOUR ACCEPTANCE OF AND ADHERENCE TO THESE TERMS.

1. Data Protection Addendum (DPA)
AgileCCPM is devoted to safeguarding Customer Data in accordance with relevant data protection regulations. By agreeing to this EULA, you also consent to AgileCCPM’s Data Protection Addendum (DPA), which controls our processing, utilization, and safeguarding of Customer Data in conformity with legal norms.
Our DPA is in harmony with the Bonterms Data Protection Addendum (DPA), which is hereby integrated into this Agreement by reference. This DPA is automatically applicable upon acceptance of the EULA and outlines AgileCCPM’s commitments to ensure the security, privacy, and lawful handling of your data within our services.
2. Service Level Agreement (SLA)
AgileCCPM is dedicated to maintaining high service availability and performance in line with industry standards. By accepting this EULA, you also agree to AgileCCPM's Service Level Agreement (SLA), which details our commitment to the delivery, availability, and performance of our services.
Our SLA is consistent with the Bonterms Service Level Agreement (SLA), which is hereby included in this Agreement by reference. This SLA becomes effective automatically upon acceptance of the EULA and illustrates AgileCCPM's responsibilities to guarantee reliable, timely, and efficient service within our applications.
3. Security Measures
AgileCCPM is committed to protecting Customer Data through strict security practices. Our adherence to the highest industry standards and Atlassian's requirements ensures robust data protection. Our applications qualify for the 'Runs on Atlassian' program, a badge of recognition for apps that meet stringent data privacy requirements.
3.1 Information Through Communication Channels
When you submit personal information via contact forms, it is exclusively utilized for communication purposes. AgileCCPM values your privacy and does not share contact form data with third parties or process it beyond the communication needs initially established.
3.2 Runs on Atlassian Program
Our apps meet the requirements of the Runs on Atlassian program. AgileCCPM's apps have no data egress and support data residency in alignment with the host product. This programmatic verification by Atlassian helps communicate our capabilities to enterprise customers with strict data privacy requirements.
Our apps meet the rigorous eligibility requirements of the Runs on Atlassian program, including no external resource domains, remotes, connect modules, or providers listed in the manifest. Our apps either use data residency-enabled Forge storage or store data in-product using product entity properties, further strengthening our commitment to data security and privacy.

4. Disclaimer
Unless explicitly stated in this EULA or mandated by applicable law, AgileCCPM offers its Products and associated services on an "as is" and "as available" basis, without any kind of warranties, be it express, implied, statutory, or otherwise. AgileCCPM disclaims all implied warranties, including, but not limited to, warranties of merchantability, suitability for a specific purpose, title, and non-infringement.
AgileCCPM does not assure that the Products will fulfill all requirements, be continuous, error-free, or entirely secure. AgileCCPM will not be held accountable for any delays, failures, errors, data loss, or damage resulting from the usage of the Products, except as specified under the terms of this EULA.
AgileCCPM has implemented this Standard Agreement to simplify licensing procedures and provide a reliable and uniform experience for all users. Bonterms, the publisher of this Standard Agreement, is not a party to this Agreement and bears no responsibility to either AgileCCPM or the Customer regarding its terms or usage.
This Agreement is solely in the English language, which will be the controlling language in all aspects. Any versions of this Agreement in any other language are only for convenience and will not be binding on the parties to this Agreement. All communications and notices made or given pursuant to this Agreement, and all documentation and support to be provided, unless otherwise stated, will be in the English language.
